Then I visited the USA and got my extension till April 2014.But due to some reason, I left the US in Jan 2014.So, my I797 and H1B stamping was valid till April 2014. Now, I have changed my company. Please let me know if my current employer can apply for the H1B transfer and extension under the old H1B CAP (i.e. cap exempt) or I need to file new H1B again.
jairichi Posted May 18, 2015 Report Posted May 18, 2015 If you have not reached the max allowed stay of 6 years on H1B then employer can file a cap exempt H1B which is nothing but a new H1B petition but no cap.
