Vink Posted May 15, 2015 Report Posted May 15, 2015 Hello there, I am on H1B and it is expiring in Oct this year. My I140 has also been approved. However for study reasons I want to take time off and concentrate on my Masters. Can I do a change of status to F1 or H4 now, and then after a year or so, can I file an extension through another company? Will there be any problems later. Thanks, Vink
jairichi Posted May 16, 2015 Report Posted May 16, 2015 With an approved I-140 there is no point in applying for a COS to F1. Go for H4. Later you can get a cap exempt H1B petition filed by an employer based on approved I-140.

Yes, you can. But, only after COS to H4 is approved EAD application will be processed. File form I539 for COS and I-765 for EAD.
