ScuderiaFerrari Posted May 14, 2015 Report Share Posted May 14, 2015 I responded to RFE on my pending I-485 along with filing I-485 for my wife when my priority date (of October 2008) was current last year. She received RFE which was responded immediately. In the mean time, I received my Green Card as I had it pending for a while. Subsequently EAD was approved and received for my wife but since the dates retrogressed back, she didn’t get her Green Card. Now I changed jobs and don't have direct access to petitioning lawyer/firm. It appears like the priority date may become current soon, what follow ups does she or I have to do with USCIS and/or elsewhere? Any experience/suggestions are appreciated. Link to comment
JoeF Posted May 16, 2015 Report Share Posted May 16, 2015 If the lawyer filed the I-485, you or your wife are the lawyer's client, so you do have access to the law firm. The I-485 is your wife's petition, not your previous employer's. If your wife no longer wants to be represented by that lawyer, she can request her file, and she needs to file form G-28 to change the representation with USCIS. Link to comment
