nik2512 Posted May 14, 2015 Report Posted May 14, 2015 I am currently on my 8th year on h1b visa . My current visa is going to expire on 15th Sep 2015 and current company is applying for extension. Eb3 I140 is approved under current employment and moved me to EB2 in Feb. Eb2 I140 will be approved in 2 to 3 months . I am thinking of changing job now and doing h1b transfer. Is it safe to do h1b transfer since my visa is expiring very soon , also if my current employer revoke Eb2 I 140 application , will it affect anything in future GC precoessing with new exmployer. Please let me know your thoughts. Thanks in advance.
jairichi Posted May 14, 2015 Report Posted May 14, 2015 It is better to leave current employer after H1B petition with new employer is approved based on approved I-140. There is a possibility of current employer revoking your I-140 or withdrawing your I-140. In that case new employer has to start your GC process from scratch. You can retain PD.

Whether current employer revokes I140 or not, if your new employer is interested to process GC for you it has to start from beginning.
