H1 Approved in 2010 - Visa Denied DO I come under Quota

Hi All,

I got an H1B approval in 2010 but My Visa was Denied, I don't know if my H1 was revoked by USCIS. Under these circumstances if I want to apply for a New H1 now, will I be considered in the H1 Quota or can I apply it other wise.

 

Any advice would be appreciated.

More information is needed but you are probably still considered counted against the cap in 2010 if you obtained a visa number and were admitted to the U.S. in H1B status.  You may want to speak with an immigration attorney about the circumstances and reasons for the H1B visa denial.
