EB-3 (India) employment based application filed in Jan 2005 through employer A. 2. My wife and I both have pending AOS applications. Both were filed in August 2007. 3. I left employer A in April 2009 (well over 180 days since concurrent filing of I-140 and I-485) and joined employer B. I switched to working from H1-B to EAD 4. Filed AC-21 after joining the new company. Had the same attorney file AC-21 5. After 2 acquisitions and 4 years of lost time with the upgrade, I left employer B and started with employer C in August 2013. 6. Started EB-2 upgrade process with employer C and a new attorney. PERM labor filed Oct 6, 2014 7. PERM labor approved March 18, 2015 8. EB-2 I-140 (premium) with request to retain old PD filed on April 20, 2015 9. I-140 approved (and old PD shows) on May 11, 2015. 10. Renewed EADs regularly (both me and wife) in 2008, 2010, 2012 and 2014. 11. Priority date is current now for AOS 12. I have copies of all the approvals (old and new) and all applications have been processed by the Nebraska center. Questions: 1. I have not filed for AC-21 after I started with employer C. Should I do that right away? Would not doing so cause any issues? 2. New attorney says that the old attorney should send the I-485 interfiling letter. I am trying to get the new attorney's office to do that, but wanted to know if one is better than the other. 3. Is the I-485 interfiling letter necessary? 4. How long do I wait to open a Service request/Infopass request?
Shresta Posted May 14, 2015 Report Posted May 14, 2015 Hi I am in similar boat like yours EB3 Priority Date June 8 2004 Filed AOS July 2007 EB3 I140 approved April 2008 Joined company B October 2008 Filed AC21 Joined Compnay C June 2012 EB2 labor filed October 7 2014 approved March 02 2014 EB2 I140 filed premium on April 29, approved on May 6th with older priority Date Waiting Today i called Customer Service and spoke with L2 officer he gave a reference number to wait for 2 weeks
