nainaagarwal Posted May 13, 2015 Report Posted May 13, 2015 I work with a company A on a client site and now the client wants to hire me full time. But Company has filled my GC and my PERM got approved in feb and he is filling my I-140 next month. The client's job doesn't require a Masters degree but requires a bachelor's degree. However company A has mentioned Masters (as I have a masters from US) required for the job I'm doing. Please help with following questions: 1. In order to file as EB2 , does employer B have to mention in job requirements for a Masters degree requirement or can they write 'Its desired' and this would also qualify me into EB2? 2. If employer B file my GC for a business analyst (same job position as employer A), can employer B use the old PERM (filed by employer A) or would they still need to start the GC process all over again with a new PERM and I-140 but port the I-140 date? 3. what happens if employer A revokes the approved I-140 before company B starts the GC process. can I still retain the PD? Thanks
rahul412 Posted May 14, 2015 Report Posted May 14, 2015 1. They have mention it in the ad. 2. Yes, they have to start from the beginning. But you can use your old PD. 3. Yes, you can.
