H1 to H4 application in a consular office other than Home country

Hello all,

I am trying to figure out some information but couldn't find a reliable source. My situation is as follows:

--- Currently on valid H1 in US

--- I am trying change to H4 status based on my spouse H1

--- I was told if H4 change of status is applied in US it will take 2 to 3 months but will only take a few days if applied at a Consular office outside office.

--- Don't want to go all the way to India (I am indian national), so trying to figure out a embassy in Western Hemisphere I can go to get this accomplished.

--- So far Jamaica and Bahamas websites explicitly wrote that they will not process this type of application but it is not very clear regarding Canada, Belize, Costarica or Mexico. Can anyone please point me to a right source where I can research this information?

Any of these embassies will work for me : http://www.usembassy.gov/wha.html

Thank you!

@pontevecchio. The change to H4 is only temporary, I would like to switch back to H1 again soon. My understanding is that filing for H1 when H4 COS is pending is risky and I am better of going to consular processing because it is immediate (according to my attorney). Do you know if any of the embassies will process this application?

Hi,

I am currently facing the same situation i.e trying to change status from h1 to h4 and cant wait 3 months for change of status.

   I cant find any info on whether i can go to Canada for cos or not. Did you go to Canada for COS and were there any issues ?

Your help is much appreciated, Thank you.

@sambha83:

I went to Vancouver consulate a month ago and did the H1 to H4 COS. It took 3mins for the visa officer to get me out of there with H4 visa. No issues on that, but I have to let you know that I went there in the wrong time (when the visa servers went down so there was a week delay in getting my interview done. That is not related to your question, but wanted to be aware of the risks.
