praneerich Posted May 8, 2015 Report Posted May 8, 2015 I just got 3 years of h1b approved. I have previously worked on H1B visa for 1 year. This is my second extension. However now I want to get a surgery done in India and take 8 - 9 months break. Please guide me regarding the following questions 1) If I take 12 months break outside the country, how easy or difficult is it for me to come back to the US on my H1B? 2) What are the consequences of such extended break on my employer. Will he incur expenses to keep my H1B? 3) My break is for surgery and spending time with family. Will such a career break impact the future H1B when I come back? Thank you

JoeF Posted May 8, 2015 Report Posted May 8, 2015 You can come back just fine, with the old H1 or a new one. You need to have documentation that the job still exists for you. That's it. There is nothing else you have to worry about.
praneerich Posted May 12, 2015 Author Report Posted May 12, 2015 I am thinking of going for the interview and getting a stamp for 3 years of H1B for which my petition was approved. Once I get the stamp, I will not travel, but take the really long break, get my surgery done and then come back with the valid stamp in passport. Hopefully that sounds like a valid plan. And ofcourse, I will ask my employer to if he could still keep the job for me when I come back which I am more than sure he will because i am really that good :).
