Previous I-797 can it be used after 6 years of approval

I have I-797 approved in 2008 which got expired on 2011 Sep 30, i did not go for stamping nor did I ever go to US, can i use the old I-797 if i have a H1B sponsor"

Thanks, do we have any supporting documents, like will 6 years H1B Status be considered from date of approval or date of expiry.

Hi Jairichi,

My situation is similar with the following details:

My H1B was approved in 2008 and when i went for stamping in Nov'08, i got 221g blue form and my emplyer was out of business in 2009 and the requested documents were never provided.

My current USCIS status shows that they have sent the notice in April 2011 which was not received and sent back to USCIS.

Please let me know whether i can apply now in cap-exmpt with another employer now.

if yes,also let me know until which year my 2008 approval is valid?
