venumek Posted May 16, 2015 Report Posted May 16, 2015 Hi Jairichi, My situation is similar with the following details: My H1B was approved in 2008 and when i went for stamping in Nov'08, i got 221g blue form and my emplyer was out of business in 2009 and the requested documents were never provided. My current USCIS status shows that they have sent the notice in April 2011 which was not received and sent back to USCIS. Please let me know whether i can apply now in cap-exmpt with another employer now. if yes,also let me know until which year my 2008 approval is valid? Kindly appreciate on the reply.
