ckotady Posted May 7, 2015 Report Posted May 7, 2015 Hi I have few queries:I am on H4 visa currently in US and my H1B got through the lottery (notified on 5 May, 2015). Assume my petition also gets approved. 1. If I do not want to work on H1b from Oct 2015, my employer would be withdrawing/revoking the petition. In such a case, will I be eligible to apply for CAP exempt H1b in future?2. Does the answer of above depends upon if H1b withdrawn by my employer was done before 1st October or after 1st October 2015?3. Is it possible to transfer H1b immediately after approval? Thanks.
jairichi Posted May 7, 2015 Report Posted May 7, 2015 1. As long as withdrawal is after Oct 1st you are fine. 2. Refer 1. 3. No.
JoeF Posted May 7, 2015 Report Posted May 7, 2015 If an H1 petition is withdrawn before the start date, the number falls back into the pool, and you would not have been counted in the quota.
wiweq Posted May 7, 2015 Report Posted May 7, 2015 You won't be considered cap-exempted. You need to show employer-employee-job exists on Oct 1st.
pontevecchio Posted May 7, 2015 Report Posted May 7, 2015 Is there any Official site stating the fact that revoking the initial H1 petition before October,1 means the fact that the op was cap counted does not matter?
