urgent... employer forgot to apply lca

hi, 

 

 

i am currently on h1 6 year and recently changed client in exactly 60 days ago. i asked employer and he kept saying yes approved and received approval. apparantly duhh he got confused with my labor perm. 

 

so to my astonishment we found just now he didnot apply lca. 

 

can any one advise me here. is it gonna be a issue if we apply lca tommorow morning with march 2 as start date in the lca application... please appreciate your time and effort

Both LCA and H1B has to be amended.

Better now than being very late. It should be fine.

Without updated LCA and H1b amendment your current new work has no authorization means illegal work. Will bite you sooner or later. Better to find better employer who can take care your immigration matters.
