chandan03 Posted May 6, 2015 Report Posted May 6, 2015 Hi, My project got completed and my new project is starting on May 11th. According to the new H1 amendment rule, do I have to file LCA and amendment and wait for approval before I start working for the new project? Or, is it sufficient to file LCA and start working and then file for the amendment? Also My current H1b is expiring on 25 Sep, 2015. So in this case can I file directly my H1b extension? Please help me
JoeF Posted May 7, 2015 Report Posted May 7, 2015 You don't file the LCA, the employer does. The employer also files the H1 extension. If the employer doesn't know how to do things, he should consult with an immigration lawyer.
chandan03 Posted May 8, 2015 Author Report Posted May 8, 2015 My employer is filing my LCA and he is planning to file amendement and extension at same time. Is it OK? As my project start from may 11, I won't be having any Client letter. Is there possibility of getting RFE ? Please help me

The employer has a lawyer, has he? If not, he should get one. Follow the advice of the lawyer.
