H1B out of cap processing

Hi,

 

My work permit was approved by USCIS in 2012 for one year (i.e. from October 2012 to October 2013), but during my stamping in January 2013 the Mumbai consulate issued me a 221(g) yellow slip for administrative processing. I received the approval for administrative processing in August end 2013, but I was not able to submit my passport for stamping as I was travelling to London for a 1 year assignment. After my return from London in September 2014, I was not able to submit my passport for stamping as my work permit had expired (was valid till October 2013).

 

As my approved work permit expired without being used or stamped, my organisation filed for out of cap/cap exempt H1b visa with USCIS and we received the acknowledgement in December 9th 2014. Since then we have not received any updates on the work permit approval from USCIS. The USCIS case status tracking page says Name was updated on 9th December 2014. Its more than 5 months and there are no updated from USCIS.

 

Can someone please let me know the processing time for cap exempt H1b visa processing and how much time would it take for my case where my work permit expired without being used/ stamped? Is there any other way we can follow up on the case?

3 to 4 months by regular processing. Your employer/attorney has to contact USCIS.
