Sandeep Posted May 5, 2015 Report Posted May 5, 2015 Dear All, Here is my situation 1. I entered in US on L-1B visa in May-2008 and went back to India in Jan-2012 after L-1B extension denial. 2. I spent 13 months outside US in same company as Managerial role and entered again in US on Feb-2013 on H-1B for same employer. 3. My H-1B was valid till 30-Apr-15. 4. My employer initiated PERM on 4-Feb-2015. PERM is Pending status with USCIS. 5. Meantime I did COS from H-1B to L-1A in PP (Approved without any RFE) 6. Currently on L1A effective from 02-March-2015 and valid till 28-June-2016 for same employer. Now my employer is filling my GC in EB1. Here are my questions: 1) Am I eligible to process my GC in EB1 category? 2) Is there any pre-requisite in terms of Number of Days to be in US on L1A before to go for GC in EB1? 3) If I am eligible for EB1 processing then what to do with existing PERM which is pending with USCIS?
