H1 H4 Unique Situation - Please help

Hi All,

 

My name is Richa. I joined my husband as H4 Dependent in Nov 2013 and got a job offer from one US company in March 2014 and they processed my H1B.

 

My name was picked in 2014 lottery and later after one RFE response I got my H1 approved on 10^th Oct 2014.

 

I was pregnant and had my baby daughter on 16^th of October 2014 therefore I was not in position to join the job therefore I applied for maternity leave and came to India with my mother in Nov end 2014.

 

Now I after a gap now I am looking to join my husband in USA.

 

I am very confused after having discussion with many people.

 

What are the options for me. Will my H1 be active. I currently don’t have job. Can I join on same H4 visa as before (Valid till Nov 2015) or I will have to go for another stamping? What will happen to my H1 if I do that. Can I get a job on that H1 in USA again?

 

Please help.

Instead of discussing it with lay people discuss the matter with the firm of Murthy. My 2 cents is that you have been capped once and are entitled to a total of 6 years in H1 status.
