off_bias Posted May 2, 2015 Report Posted May 2, 2015 Hi, I left my H1B job 2 months ago and my company said they would terminate my H1B. I am returning to India (overstayed due to certain legal reasons). But the visa stamp on my passport is valid till Jan 2016 and I have no notifications or any way to check my visa validity. Is there any website where I can enter my H1B credentials and check its validity? I am wondering if I can look for a job without returning to India. Thank you!
JoeF Posted May 3, 2015 Report Posted May 3, 2015 A new H1 would only be approved without an I-94, so you would have to travel abroad, anyway. And why didn't you file a COS to, e.g., B2? That would have kept you legal...
pontevecchio Posted May 3, 2015 Report Posted May 3, 2015 The visa stamp is only an entry stamp. If you have left the last H1 sponsor then you are out of status. You can utilize 6 years minus your existing H1 time in H1 status. Your ex employer is OBLIGATED to revoke the H1 petition. That does not affect your total 6 year entitlement. You could have looked for a job and can still do so. But you will need to leave and return with a H1 visa.

Any comments are deeply appreciated! your H1B status is automatically invalid as soon as the employment relationship is over.. for some reason, if you are obsessed with finding out if ur old employer sent the H1B revocation letter or not, it can be done on the same USCIS case status website using your H1B case number..but some times there is a delay of several months in updating these types..
