H1b to F2 to H1b

  I am on h1b working full time position and my wife is working on opt. She was not lucky in the lottery despite having advanced degree. So need to convert to H4 at end of this year when her opt expires.

 

 

 Now I wanted to take a break from my job for few months for some personal issues. I want to do right now as I can convert to dependent at this point of time.

 

 

Are there any risks involved in doing like that - changing H1 to F2 to H1 in few months in future for my GC ?? Can I take break from job as soon as I apply to COS to F2 or is it better to wait till its approved ?

Yes, you can do so. You can stop working immediately after USCIS acknowledges your COS petition with a receipt notice.
