Srinivas2187 Posted April 30, 2015 Report Posted April 30, 2015 Hi, I recently moved from company A to B for the consulting job and my H1 transfer has been denied stating employer B failed to employer to employer relationship . I got the denial on March 14th 2015 and on March 17th I travel back to India. After reaching India, on March 28th another employer D filed my H1 transfer under premium for the in house project and he got the RFE; well he responded to RFE and now on USCIS site status showing as they are going to respond by June 27th. Employer D said that there is no need of going for stamping as I have valid VISA until Nov 2015. As employer D petition; I'm planning to approach employer E to find a project and initiate H1 transfer. Also I'm thinking to travel US by obtaining visitors visa and later once H1 transfer approved, planning to apply for status Change. If I travel US on visitors VISA does my H1 valid VISA will get invalid? Please suggest which move I should take?
jairichi Posted April 30, 2015 Report Posted April 30, 2015 Avoid that travel on visitor's visa. Enter with a valid H1B visa and I797 of employer for whom you are intending to work for.
rahul412 Posted May 1, 2015 Report Posted May 1, 2015 Visiting visa while your H1 is pending is very difficult. Employer D's H1 might be rejected since he doesn't have real projects. Try to find a real employer not a shady consulting firm.
