Hello,

 

Can anyone Please assist me on this. Currently, I am on OPT working at Client Site.

I work for consulting company who has filed my H1B this year.

I was selected in Lottery and currently my H1B is in Process. 

USCIS - "Case Was Received and A Receipt Notice Was Emailed"

 

I was offered a fulltime position at my current Client Location.

But I haven't accepted it as my H1B is in process.

 

As far as I know - I need atleast two Paystubs from my previous employer while on H1B (Starting Oct 1st 2015) to transfer.

 

But I some people are suggesting me if my H1 gets approved and I have the Approval Notice Receipt I can accept the offer and start working immediately without waiting till october. As well as start the transfer process immediately.

 

Can anyone Please let me know -

 

Which of the following is recommended and Why ?

What are the possibilities if Something goes Wrong/risks/do's /don'ts

Once your H1B petition is approved let client file a cap exempt H1B petition after Oct 1st. The reason is if for any reason employer who filed H1B petition withdraws it or revokes before Oct 1st then your H1B is gone. Also, be careful about non-compete agreement signed with employer.

You cannot file for H1 transfer before Oct 1st.
