johnkala Posted April 29, 2015 Report Posted April 29, 2015 Hi I have my PERM and 140 approved with my current company under EB3. I started in my current company like: 1. java Developer 2. I had 4 years 8 months of prior experince before joining current company Now, 1. I have been promoted to Senior application developer 2. Also earned a master's degree in computer science 3. I have my PERM and 140 approved with my current company under EB3(as said before). 4. Now i have close to 7 years of experience Can my application be ported from EB3 to EB2 ?
ashuneel Posted April 29, 2015 Report Posted April 29, 2015 You can port only if, 1. you find new employer whose job requirements qualify for EB2 2. Your current employer has a new position open which is 50% different from current position and qualifies for EB2.
johnkala Posted April 30, 2015 Author Report Posted April 30, 2015 I was asking about option 2: "Your current employer has a new position open which is 50% different from current position and qualifies for EB2." Yes, My new position with my current employer is pretty much 50% different from my previous position. Just want to know if I still qualify for EB2 now? Before joining my current company I had only 1. 4 years 8 months of experience 2. No master's degree Can i use experience and education gained with my current employer in porting from eb3 to eb2?
ashuneel Posted April 30, 2015 Report Posted April 30, 2015 You need Bachelor + 5 yrs or Master's degree for EB2. You may be able to use Master's degree but not sure @ experience gained with current employer. The experience part may put other candidates ( US citzens and GC holders) at disadvantage as they have no way getting the experience gained with current employer without working there. This is not allowed for PERM process. Above all new position with current employer has to qualify for EB2 based on job requirements. Your qualifications do not matter if position requirements can be met with EB3.
