guthikv Posted April 27, 2015 Report Posted April 27, 2015 Hello all, We initiated a change of status from F1 opt to H-4 for my wife on March 5th. We got the receipt on March 20th. She quit the job on March 30th. Last week she went to India for a family visit and plan on getting stamped at Hyd consulate. my questions are: 1. What will happen to the Change of status we initiated in march? 2. Will there be any problem during stamping? 3. What documents she need for h-4 visa stamping? 4. During the interview can the Visa officer asks for her pay stubs or change of status receipt notice? Please let me know. Thanks in advance.
pontevecchio Posted April 27, 2015 Report Posted April 27, 2015 1. The COS is automatically deemed void. 2. On what basis would there be a problem? 3. The ones mentioned in the consulate website. Mainly PROOF of your valid H1 status and Proof of Marriage. 4. They may ask to see YOUR stubs. The COS is IMMATERIAL. If your H1 status is fine she will have no trouble of any kind.
abysmal Posted April 27, 2015 Report Posted April 27, 2015 1. Her COS to H4 will stand abandoned since she left the country before USCIS could approve/reject her case. She will need to apply for H4 Visa from US consulate in India and then go for stamping.
guthikv Posted April 28, 2015 Author Report Posted April 28, 2015 Thanks for the replies. One last question. I am already giving my pay stubs, i-797, tax returns, original marriage certificate. Does she need to carry any of her pay stubs (she was working in OPT)? Thanks again.
