jason0901 Posted April 27, 2015 Report Posted April 27, 2015 My OPT endorsed I20 was issued on March 13, 2015.So the 30th day can be either on Saturday, April 11, OR Sunday, April 12. I sent it on Thursday, April 9, but missed the last pick up time. So the fastest way to deliver the application is to deliver on Saturday, April 11, 2015, which is apparently within the 30-day rule. However, USCIS does not work on weekends, and I received a notice with a received date on April 13, 2015 (Monday). The date is apparently the 31th day or 32th day. Is my application considered late? How does USCIS count days for deadlines (including holidays and weekends or not)? Will I be denied for OPT application?Please help to answer. Thank you so much!

You need to account for holidays and weekends, USCIS will not care about it. 30 days is including holidays and weekends. You will get an RFE to send a new I-20 or your OPT will be denied. I am not sure of your reasons but you took a risk by sending your documents late. Unless you have a valid reason USCIS will not accept the OPT application.

There is a possibility that your sevis could have expired, check with your DSO about the status. You will have to reenter US to reactivate your sevis if that is the case. Discuss with your DSO about your specific case, they can also contact USCIS (call them directly) to obtain more information about your case.
