geekforu Posted April 25, 2015 Report Posted April 25, 2015 Hi folks, My husband and I are on H1B visa and both of us have Green card in progress from our employers. For my husband PERM has been approved but PERM has not been approved for me yet. His employer is now going to file i140. Can he list me as his dependent in his i140 ? Just in case my Green card case doesnt go through I just want to make sure I get EAD atleast through my husband and if he misses adding me as dependent then I would end up not getting anything. I just want to know if adding me as dependent in my husband's i140 and then adding my husband in my i140 (when me PERM gets approved) would create any problem.
rahul412 Posted April 27, 2015 Report Posted April 27, 2015 If you want to get H4 EAD, then you should be on H4 and your spouse should have a valid I140 at the time of filing H4 EAD.
cap-gap Posted April 27, 2015 Report Posted April 27, 2015 there is no "adding of spouse" to I140....once his 140 is approved and when his PD is current, you file your own 485 to get your EAD, based on your husband's approved I140..
