You must possess a passport valid for travel to the United States with a validity date at least six months beyond your intended period of stay in the United States (unless country-specific agreements provide exemptions "http://www.state.gov/documents/organization/104770.pdf"). My Overseas officer statement : your passport, which must be valid for at least 6 months beyond the expiration date listed on the I-797 approval notice. My Concern: I'm planning to go for visa stamping May 2015 , my passport is three days short to meet the criteria of “six months beyond the expiration date listed on the I-797 approval notice”. My I -797 Date is till 03/13/2016 & Passport is valid till 09/10/2016, India passport office won’t accept renewals before 1 year of expiration of passport, so even If I want to renew I need to wait till 09/10/2015.
shekar11# Posted April 27, 2015 Report Posted April 27, 2015 You are good. Only your passport needs to be valid for 6 more months from the day of your visa stamping. I-797 has nothing to do with passpost expiry.
ad2010 Posted April 27, 2015 Report Posted April 27, 2015 You are good to apply for US visa with your current passport. However in port of entry you may get I-94 till validity of your current passport.
