Employer B is in process of transferring my visa(No receipt yet, expecting by next week). Will I have issues during H1 Approval and stamping in India, Since I will be out of status by this weekend.

I will receive receipt notice before my last date with employer; But the new employer start date will be few days after my lay-off. So can i start with receipt notice or should i wait till my approval as I am out of status for few days after receipt notice?
