vvignesh88 Posted April 22, 2015 Report Posted April 22, 2015 Hi, My wife who was in H1b moved to new employer and her H1b transfer petition got denied. Now she is going to India to get her H4 visa stamped from US consulate. During H4 stamping will US consulate cancel her current H1b visa? If they cancel then in case if she gets a job in future in the US, then she has to go through H1 lottery cap again? Please help me with the above issue. Let me know if you need more details. jairichi Posted April 22, 2015 Report Posted April 22, 2015 US consulate might or might not cancel her H1B visa. If she has not reached the max allowed stay of 6 years on H1B then she will be cap exempt.
JoeF Posted April 23, 2015 Report Posted April 23, 2015 A visa is an entry document, nothing else. If she has been counted for the quota in the last 6 years, she is not counted again, and a new employer can file an H1 petition at any time.
