jvj Posted April 22, 2015 Report Share Posted April 22, 2015 Hi!,My H1 extension got denied. The reason for denial is that my employer didn't run my payroll for 2 months when I was on bench. What would be my best option to get my H1 extended. Also what is the time duration that I can stay in US after the day of denial published by USCIS or is it something that counts from my day of visa expiry. jairichi Posted April 22, 2015 Report Share Posted April 22, 2015 From the date of denial you are accumulating illegal stay in US. You need to exit immediately. File a complaint against employer with DOL for not paying your salary while on bench. Link to comment

The ONLY option is getting paid. On H1, a person has to get paid ALL THE TIME, even on bench without a project. That's the law, and the employer knows it. File a complaint with DOL on form WH4. The DOL will make the employer pay you. And find another employer, one who isn't such a fraud as the current one. Link to comment
