I-140 Pending, Change of jobs in another division of the Same Parent Company

Hello All, 

 

I have a complex situation regarding H1B and I-140 Transfer. 

 

I am working for Division A in the Parent Company X. 

I am working on an opportunity with Division B in the same parent Company X. 

 

My H1B Docs have the petitioner name as Division A. 

 

I am in my 4th year on H1-B and also have an i-140 which is pending.

 

If I change jobs, since it is in the same parent company can I maintain my PERM and I-140 or should the new Division apply for a new one?

 

If so, will my priority date be same? 

 

Please review and advise.

You need to file new Labour and I140 if you change the employer who filed it. As long as there is no change in the employer, you dont need to file it again.
