DjIndia
Hi I have got H1B stamped in October 2006 and which got expired on Oct 2009. I have never traveled on this visa to USA. Just wanted to know if i can transfer this visa under CAP exempt category. What I came to know is that I can transfer it as per the clause g.2 under Section 3 in I129 form. Can somebody confirm on this? Link to comment
jairichi
Yes, an employer can file a cap exempt until you reached the maximum allowed stay of 6 years on H1B. Link to comment
DjIndia
Thanks Jairichi .... so it is irrespective of 6 years from last H1B filing status ... is that correct???? Because in my case, visa stamped on October 2006 which is now almost 8 years back .... Link to comment
