planotx1710 Posted March 31, 2015 Report Share Posted March 31, 2015 I am currently on H1-B (valid 2014-2017) planning to get married by the end of this year. My fiance is a US citizen and we plan to visit India for some personal work in May-June 2014. I would need to get my H1 stamped them. What would be the best time to get my H1 stamped as I am a consultant with IT company. I don't want to go to India and get stuck due to H1 stamping. Also can you suggest if there is any other approach we can take so as to minimize the risk of getting stuck in H1 stamping.Also in the worst case scenario if I do get stuck in India, how long would it take for my husband (now fiance) to sponsor me and get me back here ?Please let me know if you have any further information to add to this. pontevecchio Posted April 1, 2015 Report Share Posted April 1, 2015 Get married during your trip. Have him file your I-130 as soon as you are married. You apply for the H1 visa during the visit and if you get it come over and file for AOS as soon as the I-130 is approved. If the H1 visa is delayed it will take about 6-8 months or less for your IV interview at the local Consulate involved. Link to comment
