h1bgcgoodluck
Hi, I am on H4 visa currently and I had applied for H1b in April 2014. USCIS approved my H1b visa before 2 days but they denied change of status from H4 to H1b. They issued I-797B informing to travel out of country, appear for visa interview and enter USA with H1b stamp in-order to change the status to H1b. If I don't wish to accept this H1b visa, therefore don't travel out of country and stay on H4 visa, then my application is considered approved or denied? Can I use the same EAC number in future to apply for H1b as cap exempt or a have to file a fresh H1b visa following the cap rules and regulations? Thanks Link to comment
rahul412
Yes, your petition is approved but not COS. So you can use this petition in future for cap exempt H1. Link to comment
