She got her H1b stamped in 2008 but never travlled to usa. She is in usa on H4. Will her H1B be valid for CAP Exemption ? In few forums I see people mentioning that it will be valid for only 6 years from year of approval. If somebody can clarify on this it would be of great help. Regards PRem Link to comment

wiweq Posted March 11, 2015 Report Share Posted March 11, 2015 She will be cap exempted for 6 years on H1b stay in USA. If she never worked on H1b in USA, she still has full quota of 6 years to work on H1b in USA. (Doesn't matter when H1b was approved) Link to comment
