I am currently employed with Company A on H1B(Valid till 2017) and Company B is ready to file H1B for me(H1B Transfer). They would do standard Processing and want me join as soon as USCIS acknowledgement receipt is received. Question- 1) Is it safe to join companyB based on USCIS petition receipt acknowledgement? jairichi Posted March 9, 2015 Report Share Posted March 9, 2015 1. It is not safe at all. Join employer B only after H1B approval. If they need you that urgently ask them to file in premium processing. The fee can be paid by employer or borne by you. Link to comment
wiweq Posted March 9, 2015 Report Share Posted March 9, 2015 Don't join new employer on receipt. Ask them to file your H1b in PP, once approved only than resign from current employer. H1b in PP and joining will take max 1 month, any good employer should do this. If you join the new employer on receipt and if it could not approve, leaving US will be only option! Link to comment
