metapands
Hi, My Employer is getting ready to file my H1-B extension. My H1-B visa was applied on April 2007 Cap and got approval in October 2007. So I travelled and stayed in USA from 1st Mar 2008 to 24th Dec 2008 and then went back to India for more than a year and returned back to USA again on 11th Jan 2010 on the same H1B visa and staying till now based on H1-B extension. Here is my stay details: 1st March 2008 to 24th Dec 2008 11th Jan 2010 to 25th March 2010 13th April 2010 to till date My current I-94 is expiring on 22nd June 2015. With the above stay dates mentioned, hope you can understand that I was out of the country couple of times. So I assume that I will be eligibile for the recapture request. Based on the recapture request for extension, could you please let me know how many more months I can get approval for my H1-B extension? Thanks. Link to comment
JoeF
You count the time you were in the US on the H1, subtract that from 6 years, and that's the time you can recapture. Link to comment
