My previous employer said he wont revoke my H1 by informing uscis untill I inform them. Will I have any out of status problem. Link to comment
jairichi Posted March 4, 2015 Report Share Posted March 4, 2015 1. Attorney gets an email within a day or two. 2. Doesn't matter. If you are not working for previous employer and H1B petition from new emplyer has not reached USCIS you are out of status. 3. Less than a week might not be an issue. Link to comment
wiweq Posted March 4, 2015 Report Share Posted March 4, 2015 LCA take anywhere 1 to 2 weeks. You will be counted out of status for the days between your termination from the previous employer and filing date of new H1b. Your previous employer revokes your H1b or not doesn't affect your out of status days. Link to comment
