Manisha1805
Hello Experts, I came to USA on H4 Visa and got H1B petition approved (I-797B) in Sept'2014 through one employer. My status was not changed to H1B since I traveled to India while H1B visa was in process. My living status in US is H4 and my visa and i-94 are valid till Sept'2015 for my H4 status. I don't want to work with the employer who filed H1B for me due to location constraints. My query is, if I search a job, can my new employer file my H1B transfer since I don't have any paystubs (I was never on H1B status)? Also, if they can file h1B transfer can it be done with change of status from H4 to H1B so that I don't need to go out for stamping? Thanks in advance. Thanks & regards, Manisha Link to comment
jairichi
Yes, an employer can file a COS to H1B. You can start working immediately after approval. Link to comment
