maxb Posted January 23, 2015 Report Share Posted January 23, 2015 I am came to the United States on H1B visa status in June 2000 and worked in this status until June 2002. In July 2002 I converted to G-4 visa status (a special visa category to work with international organizations) and have been working on G-4 until now. I now have another employer who has offered me a job but I have to convert to H1B again. My questions are, 1. Can my old H1B be renewed after a gap of 12.5 years? Need a definitive answer. 2. If answer to above is Yes, can it be renewed right away (in Jan/Feb) or will we have to wait until April 1st to apply for renewal? 3. Or will my new employer have to file for a new H1B altogether as early as April 1st? Thanks much in advance! Link to comment

You can work after getting the H1 petition approved and you may need to leave and return with the H1 visa after that. 3. You are entitled to the "remainder option" as described by USCIS. 4. Let your potential employers Lawyer sort it out. If you must, talk to the firm of Murthy or any of your choice. Link to comment

So I can have my employer file the petition for H1B renewal right away and not have to wait until April? It also seems like once the petition is approved I can work legally - the actual visa needs to be stamped on the passport only if you need to travel correct? 3. What is the "remainder option"?
