mekri Posted January 16, 2015 Report Share Posted January 16, 2015 I am on a non-profit H1B now. Recently I got a job offer from a for-profit company and would like me to join as soon as possible. Can any of you suggest what will be the best way to do this? Is there anyway for me to join the new company just after applying in April (in case I am approved)? What is the earliest joining date? Alternatively, can I apply for a concurrent H1B? Link to comment
jairichi Posted January 16, 2015 Report Share Posted January 16, 2015 If a cap subject H1B petition was filed in April and selected in lottery for processing then you can join new employer till a decision is pending with USCIS. If approved before 1st Oct you will need to stop working for new employer and join them later from 1st Oct. Link to comment

If the lottery is then in my favor, then I will need to stop working for the new employer and then rejoin them again? Is that true? In that case, what will happen if my application is rejected. I will loose both the H1? Yes, once approved you need to stop working for new employer and can continue only after H1B start date of Oct 1st. If cap subject H1B petition is denied and if current employer has not revoked your H1B petition you can go back and join them. It is always better to have concurrent employment with current and new employer. In this way you will be safe. Link to comment
