ganesh711 Posted January 14, 2015 Report Share Posted January 14, 2015 Hello, I am currently on H1B visa which will be expire on Dec 2016 and my husband is on F1-OPT visa. As i am pregnant, i want to stay with my husband , but my employer forced me to go to different states for work and i am not comfortable to move around different states in Pregnancy situation. My I140 is approved and my priority date is in 2011.. So, i am thinking to go on F2 Visa and request my employer that please do not revoke my I140. once, my pregnancy will be over , then i wanna join him back and he will file my H1B again So, i have few question. 1. My husband will file his H1B in April and suppose, if i will convert on F2 rightnow, Does my F2 status will convert to H4 in October (Based on My husband Status) or should i have to file separate application for that ? 2. If F2 to H4 is possible, then i can go on H1b again from H4 & i can stick with same priority date for GC or not ? 3. Suppose during F2 or H4 visa status, if my PD become current , then what will be the option ? Thanks, Ganesh Link to comment

Once your spouse's H1B petition gets approved and he moves to H1B status from Oct 1st you will need to file a COS from F2 to H4. Alternatively, your spouse's employer can file your COS from F2 to H4 along with your spouse's H1B petition. 2. Yes. 3. One of the rarest to happen. Link to comment
