H1 Transfer after 8yrs on h1b with approved i140 which could get revoked before h1transfer completes

hi 

 

the case: 

 

- on my 8th year of h1b

- i-140 is approved with early 2011 PD 

- current h1b valid until mid 2016

 

questions:

 

- I need to find another employer and transfer my h1b. What are the chances of h1B approval if USCIS find out I-140 is revoked ? 

 

e.g. Jan 15 - employer A revokes H1B, and I-140 
      Jan 14 - employer B files for H1b transfter 

 

in above e.g. - what are the chances of getting h1b approved ? 

 

 

- Is it possible to stay legally on other status (e.g. F1, F2, or H4) and still use PD from approved i-140 after a year ?

3. On H4 yes. It is not possible to move to F1 or F2 as an I-140 has been filed and approved.
