gvnkiran Posted December 11, 2014 Report Share Posted December 11, 2014 Hi, I have filed my H1B from India in March April 2014. But later I got married and came to US in June 2014 on H4 Visa. Now I got my H1B approved without I-94 attached to it since I filed H1B from India. It has mentioned my Consulate as Hyderbad - India on my petition. Now since I am in US can I go to nearby Country and get my stamping for H1B or Do I need to go to India for stamping? since Change of status amendment and going to India is costlier process and time taking. Can I go to nearby Country for stamping since it was mentioned as Consulate:Hyderbad on my petition. Thanks, gk Link to comment
jairichi Posted December 12, 2014 Report Share Posted December 12, 2014 You can go to any US consulate that will entertain your visa applications. For TCNs (Third Country Nationals) it is always suggested to go to home country. Link to comment

If it is a cap subject H1B petition filed in April then one can go for visa stamping not more than 3 months before H1B start date. Link to comment

Either you can go for stamping not more than 3 months before H1B start date and enter not more than 10 days from H1B start date. Or employer can file a COS and and only after approval you can start working but not earlier than Oct 1st. For COS employer has to pay H1B fee again. Link to comment
