kkpatel3 Posted December 8, 2014 Report Share Posted December 8, 2014 Dear Sir/Madam I came to US on 2007 and finished my MS in DeC,2008. My H1B application was approved in June 2009. Then My H1B was revoked by my employer and I filed COS from H1 to F1 and it was approved in March,2010. Since then I am on F1 visa and I finished my PhD in US. Now I am working and my employer may get ready to file my H1B. My H1B was initially approved in 2009 so will I count towards quota ? Can I file at any point of time? Please do let me know. Thanks. And there technically is no such thing as a transfer. It is always a new H1. If the OP hasn't used the full 6 years, an employer can file an H1 at any time. Link to comment
kkpatel3 Posted January 5, 2015 Author Report Share Posted January 5, 2015 H1 withdrawal request was sent in sept09 and got reply from USCIS in Dec,09. In the mean time I had applied for COS fro H1B to F1 In oct,09 and it was approved in March,10. So I guess my H1B was activated in Oct 09. Link to comment
