sri69
Hi, Can any one please suggest me on this ? My wife is on H4 visa which will expire in March-2016. She is going to travel to India now and I am planning to change to employer B in Jan-2015. Lets assume my H1 approved with employer B in Jan-2015. So, When my wife returns to USA in Feb-2015, Do she needs to go for stamping with new I-797 (emp B) ? Regards sai Link to comment
jairichi
No need for new H4 visa stamping. She can travel with her existing valid H4 visa and a copy of your new I797. Link to comment
ashuneel
NO. she needs a copy of your I-797 from new employer and her new H4 I-797 with valid I-94 in it. Link to comment
jairichi
NO. she needs a copy of your I-797 from new employer and her new H4 I-797 with valid I-94 in it. Her H4 I797 is not required as it is irrelevant. She needs a copy of OP's new I797. Link to comment

ashuneel
Thanks jairichi and ashuneel for the response. Ashuneel, What is "new H4 I-797 with valid I-94 in it" , Do you mean my new H1 copy (I-797) ? Assuming I-539 was filed for her at the time your H-1b petition was filed she will get a new I-797 showing dependant status ( H4) with I-94 attached. Link to comment
