vaibhav123
Hi, I'm working in the US on a valid H1B visa. I've been here for a while and was planning on applying for a B2 visa for my mum to come visit for a couple of months. Mum is legally separated and things had gotten a little ugly about 6-7yrs ago when she had filed for divorce and dad wound up filing a trespassing complaint against her for which she had been arrested and was immediately let out on bail. Later the courts dismissed the case calling it a senseless complaint and stating that it was her own marital home to begin with and it was insane to suggest that one could trespass their own house. It further stated that the complaint seems to have been filed as a counter blast to her petition for divorce. It said the case had no merits and hence it was dismissed. Now my mum is not financially sound to sponsor her own visa though she owns a decent amount of property back in India, so I would be her sponsor. I wanted to know what kind of an impact would her prior arrest despite the dismissal of the case and the fact that she is legally separated have on her chances for a B2. Thanks in advance. jairichi
First there is no sponsorship involved. Your mom should carry all her court papers along with other supporting documents for visa interview. Her application will be judged based on her strong ties to home country, Link to comment
