jay25oct Posted December 1, 2014 Report Share Posted December 1, 2014 Hi All recently i am going to transfer from employer A to employer B. i have pay stubs until oct 15 2014 and after that i am on unpaid leave, so there are no paystubs. so my question is suppose i got a job offer from employer B does transfer can be done on the basis of paystubs until oct 15 or should i need most recent pay stubs? What's the reason for this "unpaid leave"?? hi rahul the reason for unpaid leave is i am in india for some reason, so i think there is no need to run paystub. so suppose i get a job offer from employer B i dont have latest pay stubs. My employer paid me until oct 15 and after than he has shown me on leave. so my basic question is if its possible to switch from employer A to B based on paystubs until oct 15? Link to comment

You can move to a new employer once a cap exempt H1B petition filed by them is approved. Link to comment

If you are outside the US during that time, then you are safe. When you are outside the US you longer on H1, so no need to get paid. Yes its possible to switch employers with your pay stubs. Yes its possible to switch employers with your pay stubs. thanks for reply. my h1 b is valid until oct 2016, so if i take unpaid leave for 4 months and stay out of USA, is there a chance of me grilled by visa officer at the port of entry for being out of country for such a long time and send me back to home country from there? Is there a certain limit for h1 b holders for being out of country no matter what the reason is? Link to comment

You can be outside the US for as many days as you wish since you're not a US citizen. Link to comment
