sri.gaurav80
I had applied for Student Visa conversion ( H4 -> F1 ) in the month of May, 2014. However, My visa application has been denied by USCIS on 31st of Oct,2014.Reason for denial : Erroneous entry in my i94 record, which states that I've departed US on 21st oct,2014.CBP department said these entries can be corrected only through IOFA request which may take longer time and I've to respond to USCIS within 33 days in case of opting "Motion to reconsider" i94 record says my latest admission date to USA is oct,2013. However "travel history" in i94 record reflects the wrong entry of "21st oct, 2014" departure from US without any port of exit. Please advise. Link to comment
jairichi
Talk to an attorney. I would suggest you to exit and enter US with a valid F1 visa if being on F1 is that important. Link to comment
sri.gaurav80
once I receive the correction on my i94...can I reapply ? What would you suggest ? Should I hire attorney and move ahead with this i94 ( stating it is CBP system fault and grant me F1) ? or should I wait for correction to happen and then reapply ? Link to comment
