nutan76
Need help with some basic question. I have come to US in 2011 on L1B, had to leave US due to denial of extension in Aug 2014. Fortunately, had applied for L-H conversion, got through lottery, came back last month on H-1B, is valid till Sep 2016. Meanwhile, my GC application was filed in EB2 in March this year, got PERM approved last month. 1. Should I file my I-140 in normal or premium (I will have to pay for premium)? What is the benefit for me to file in Premium. 2. Change of Job - will I be able to change my job after I-140 approval or does I485 also needs to be filed before I can think of job change? As I understand, I cannot apply for I-485 till my date is current, which could be another 5 years....does that mean I cannot change my job till then? Link to comment
pontevecchio
1. The only benefit is that you will know sooner. You need to ask your Lawyer whether you even qualify for Premium Processing. 2. The GC filing is supposed to be for a job which you will take up on approval of your AOS in thye future. You do not necessarily need to work for the same employer in the meantime. Link to comment
ashuneel
1. only benefit of premium processing will be approval in 15 days instead of 4-6 months. 2. you can change job after I-140 approval. You do not need I-485 for job change. Link to comment
