sumanchevuru Posted November 11, 2014 Report Share Posted November 11, 2014 I came to US with employer A and after comming here my VISA got renewed and its valid up to 07/09/2015. I have transfered employer to B and started working on the reciept. Now my H1 transfer status is in RFE and last date to respond to RFE is December 14th 2014. Since getting the cleint letter with the required format is difficult to the employer B, he suggested the client(employer C) to take me to their payroll Employer C is looking for the possiblity to initiate the H1 transfer. Please advise if this is possible and suggest me what are the risks behind this approach Link to comment

ashuneel Posted November 12, 2014 Report Share Posted November 12, 2014 It is possible. There is always a risk of RFE for employer C application also. There are 2 options: reply to RFE or employer C needs to initiate cap exempt H-1 petition. Link to comment

Only if employer C's petition gets approved without I94 or employer A revoked your H1B petition and employer B's H1B petition is denied. Link to comment
