One qualifying criteria for the H4 is that the H1b spouse should have an approved I140. My situation is: I have my I140 approved, but will need to find a new employer due to personal reasons after my spouse obtains the EAD card. My question is: will the card be somehow "invoked" once I terminate my employment with the current employer, which automatically invalidates my I140. Or she gets to use the EAD till the expiration date on the card. In other words, the criteria only applies in the application step. This may sound like asking people to predicate the future. But the full text of the proposed rule is available. My question is based on that version of the rule and I understand the final rule, if passed, could be different. I read the full text already but can't figure out the answer. I deeply appreciate it if you can shine some light on this important matter for us. Thank you. Link to comment

You know that no one can predict what happens to this proposal in future, so why are you wasting your time. EAD is future, think about present. Link to comment

It's totally true that no one can predict whether the rule will be published at all. It's just my spouse needs her work permit badly and I can afford to wait a few months and see. Link to comment
